  5. Undertaking warning

The consent order precedent does not include the obligatory warning for undertakings.

  6. Could the precedents not provide for husband and wife

It is very confusing for parties as to whether they are the Applicant or Respondent often the person who was the Petitioner to the divorce is actually the Respondent in financial matters. Could the precedents not make provision for Husband / wife to be added to the Applicant and Respodent

  7. Why does the precedents refer to applicant and respondent with no capital letter at the start.

The precedents throughout should refer to the Applicant and the Respondent using capital letters in accordance with English Grammar. Very time consuming going through whole precedent to change once downloaded.

  10. change headnote - no provision under the M(SSC)A for making financial orders

The current precedent headnote for consent orders gives three options for the regime under which the financial order is to be made:

    MCA 1973
    CPA 2004
    M(SSC)A 2013

The third should not be there. There is no provision under the M(SSC)A for making financial orders (unlike the CPA).
What the M(SSC)A does is to extend the existing statutory provisions re marriage to same sex couples.
So financial orders for divorcing same sex couples will be made under the MCA 1973.

  12. When exporting to word document can the recitals be set out as Paragraphs A, B etc and the clauses as 1,2,3

When you download to word document it is very much all over the place and the clauses retain the numbers from the precedents and do not flow in nice order taking a lot of time to tidy the order up and make clear. Surely when downloading the recitals could come out A,B,C and the clauses of the order as 1,2,3,

  13. Reintroduce “Christmas orders”

current draft Consent Order Precedents do not contain Child maintenance “Christmas orders” as in the previous version. Is there a reason for this?

  14. Mesher/Martin orders. Why cant we have a precedent for the trust terms? at least basics like triggers and so on

The Mesher/Martin order footnotes say the trust needs to be drafted by a specialist.

surely that is our job? things like the trigger for sale or end of trust and who pays for structural repairs etc could be in a precedent format...

  16. I work on a Mac. I've got Word, but I much prefer to use OS X Pages.

Can Pages (.pages) be added as an export format please?

    Hi there Stephen -

Thanks for your suggestion. We know we have a growing number of Mac users. We’ll monitor this as the user base grows in the coming weeks and days.

We will add this as a possible update checking with the technical development team about what’s involved setting this up and maintaining it in future. Patrick

  18. Add signature clauses for parties and solicitors to sign at end of document

Add signature clauses for parties and solicitors to sign - for use when Consent Order lodged as a box work application.

  19. Prec 53 - include option to override the link between applicant/respondent in first and second paragraph

There's an assumption that if it is applicant in first para transfer to the applicant - that they also have conduct of the conveyancing. This isn't always the case.

  20. I want to be able to search all the precedents

It would be great to be able to search for text within precedents - to find the one you need.
